1. Introduction
These Terms & Conditions (“Terms”) govern access and use of the Energy Meter & Electrical Services Application (“Platform”) operated by Klonec Automation Systems (“Company”, “We”, “Us”).
By registering or using the Platform, you agree to comply with these Terms.
2. Definitions
- Consumer/User – Individual requesting electrical services.
- Contractor – Licensed electrical contractor registered and approved on the portal.
- Service – Electrical works listed in the service catalogue.
- SLA – Service Level Agreement timelines configured by Admin.
- Premium Subscription – Paid access to additional service categories.
- DPDPA – Digital Personal Data Protection Act, 2023.
PART A – TERMS FOR CONSUMERS
3. User Registration
- Users must provide accurate details during registration.
- OTP-based authentication may be required.
- Users are responsible for safeguarding their login credentials.
4. Service Requests
Services are provided by independent contractors. Pricing is determined based on:
- Service type
- Location classification (Urban / Semi-Urban / Rural)
Final cost = Base Service Price + Add-ons + Applicable Taxes.
5. Payments
- Payments must be made through the integrated payment gateway.
- Cash transactions outside the platform are discouraged and not covered by dispute resolution.
- Platform may deduct service fees before transferring balance to contractor.
6. Cancellation Policy (Consumers)
6.1 Before Contractor Acceptance
6.2 After Acceptance but Before Job Start
- Cancellation fee may apply (e.g., visit charge).
6.3 After Job Start (OTP Verified)
- No cancellation allowed unless mutually agreed.
- Refund subject to dispute review.
7. Refund Policy (Consumers)
Refunds may be processed under the following conditions:
- Service not delivered.
- Contractor fails to attend within SLA.
- Duplicate payment.
Refund timelines:
- Processed within 7–10 working days.
- Refunded to original payment method.
Refunds will not apply for:
- Completed and OTP-confirmed jobs.
- Dissatisfaction without technical defect evidence.
8. Ratings & Conduct
- Consumers may rate contractors.
- False complaints or abusive conduct may result in suspension.
PART B – TERMS FOR CONTRACTORS
9. Contractor Registration
- Contractors are onboarded by Admin only.
- Valid license and certifications must be provided.
- Bank details must be accurate.
10. Subscription & Fees
- Premium services require registration and renewal fees.
- Non-premium contractors may only access specified services (e.g., energy meter installation).
11. SLA Compliance
Contractors must:
- Accept/reject requests within SLA.
- Start and complete jobs within SLA.
- Use OTP verification for job start and completion.
Repeated SLA breaches may lead to:
- Warning
- Temporary suspension
- Permanent deactivation
12. Payment to Contractors
Payment settlement after job completion and confirmation. Platform may deduct:
- Service fees
- Subscription charges
- Applicable taxes
Settlement timelines: T+3 working days.
13. Cancellation by Contractor
- Contractors must not cancel accepted jobs without valid reason.
- Excessive cancellations may lead to penalties.
14. Independent Contractor Status
Contractors are independent service providers. The Platform does not employ contractors nor guarantee specific income.
PART C – DATA PROTECTION & PRIVACY
This Platform complies with the Digital Personal Data Protection Act, 2023.
15. Data Collection
We collect:
- Name
- Contact details
- Location information
- Bank details (contractors)
- Transaction data
Data is collected only for lawful purposes, including service delivery, payments, and regulatory compliance.
16. Consent
- Users provide explicit consent during registration.
- Consent may be withdrawn at any time, subject to legal and contractual obligations.
17. Data Principal Rights (Under DPDPA)
Users have the right to access personal data, correct inaccurate data, erase data (subject to legal retention requirements), and nominate a representative.
Requests may be submitted to the Grievance Officer.
18. Data Security
- Reasonable security safeguards are implemented.
- Data is stored securely.
- Unauthorized access or breaches will be handled per legal requirements.
19. Data Retention
Data is retained only as long as necessary for service completion, legal compliance, and dispute resolution.
PART D – GENERAL TERMS
20. Limitation of Liability
The Platform acts as an intermediary between consumer and contractor. We are not liable for:
- On-site accidents
- Property damage caused by contractor negligence
- Indirect or consequential losses
21. Dispute Resolution
- Disputes must first be raised through in-app grievance system.
- Jurisdiction: Courts of Karnataka, India.
- Governing Law: Laws of India.
22. Modification of Terms
Company reserves the right to modify these Terms. Continued use constitutes acceptance of updated Terms.
